Abstract: This study delves into the formative period of Ḥanafī uṣūl al-fiqh, investigating its emergence as a distinctive literary genre. The research employs a meticulous comparative analysis of five seminal Ḥanafī texts, namely al-Fuṣūl fī al-uṣūl by al-Jaṣṣāṣ al-Rāzī (d. 370/981), Taqwīm al- adillah by Abū Zayd al-Dabūsī (d. 430/1039), Uṣūl al-Sarakhsī by Shams al- Aʾimmah al Sarakhsī (d. 483/1090), Kanz al-wuṣūl by Fakhr al-Islām al- Bazdawī (d. 482/1089) and Mīzān al-uṣūl fī natāʾij al-ʿuqūl by ʿAlāʾ al-Dīn al- Samarqandī (d. 539/1145). The primary focus of this comparison is the subject of tacit consensus (al-ijmāʿ al-sukūtī), which will be studied and traced chronologically within the context of these major texts.
